STJ Creations株式会社(以下「当社」といいます。)は、その運営するオンラインショップ「sentoujours.」(以下「当サイト」といいます。)において提供される当サイトの閲覧、商品購入、会員登録およびこれらに関するサービス(以下「本サービス」といいます。)の利用規約(以下「本規約」といいます。)を次のとおり定めます。
第1条 本規約の適用範囲
1 本規約は、当サイトの利用者(以下「お客様」といいます。)と当社との間の本サービスの利用に関わる一切の関係に適用されます。
2 当社は本サービスに関し、本規約のほか、各種のルール等(以下「個別規定」といいます。)を定めることがあります。個別規定は、その名称にかかわらず、本規約の一部を構成するものとします。
3 本規約の定めと、前項の個別規定とが矛盾する場合には、個別規定が優先されるものとします。
第2条 本サービスの利用
1 お客様は、本規約および個別規定の内容のすべてに同意の上、本規約および個別規定を遵守し、当サイトをご利用するものとします。
2 お客様が未成年の場合、法定代理人の同意を得た上で、本サービスを利用するものとします。
第3条 会員登録
1 お客様は、本サービスを利用するにあたり、会員登録申請を行うものとします。
2 お客様は、本規約および個別規定に同意の上、当社が定める方法に従って必要事項を登録し、当社が登録申請を承認した時点で会員登録が完了します。
3 当社は、以下で定める各号に該当する場合、会員登録申請を承認しないことがあります。なお、不承認の理由について開示は行いません。
- 会員登録申請者の申請内容に虚偽の事項が含まれている場合
- 本規約および個別規定に違反したことがある場合
- その他、会員登録申請を承認することが不適当であると当社が判断した場合
第4条 本サービスの提供停止および会員登録の抹消
当社は、お客様が以下で定める各号に該当する場合、お客様に事前通知することなく本サービスの提供の停止または会員登録の抹消を行うことができるものとします。
(1)本規約違反等による会員登録の抹消が行われていることが判明したとき
(2)本サービスに関する代金の支払いの遅延その他債務不履行があった場合
(3)第6条に定める禁止事項に該当する行為を行った場合
(4)未成年者が法定代理人の同意を得ずに会員登録または本サービスの利用を行った場合
(5)第18条に定める反社会的勢力に該当する場合
(6)その他本規約または個別規定に違反した場合
第5条 退会規約
1 退会を希望する場合には、お客様は当社が指定する方法に従い退会申請を行うものとします。
2 お客様は、退会手続後は本サービスの利用ができなくなります。
3 当社は、お客様の退会後も、一定期間の間、適用法令に従いお客様の情報を保持する場合があります。
第6条 禁止事項
お客様は、以下で定める各号の行為を行ってはならないものとします。
(1)会員登録の際に虚偽の登録内容を申請する行為
(2)本サービスの運営を妨げる行為、その他本サービスに支障をきたす恐れのある行為
(3)クレジットカードを不正使用して本サービスを利用する行為
(4)メールアドレスおよびパスワードを不正に使用する行為(他のお客様に成りすます行為も含みます。)
(5)他のお客様、第三者もしくは当社に迷惑、不利益もしくは損害を与える行為、またはそれらの恐れのある行為
(6)公序良俗に反する行為その他法令に違反する行為、またはそれらの恐れのある行為
(7)当社またはその他の著作権者等正当な権利者の知的財産権を侵害する行為
(8)当社のサーバーまたはネットワーク機能を破壊・妨害する行為、その他当社サービスの運営または他のお客様による当社サービスの利用を妨害し、これらに支障を与える行為
(9)その他、当社が不適当と判断する行為
第7条 著作権
1 本サービスにおいて使用されている文言、画像およびデザイン等に関する著作権または商標権、その他全ての知的財産権は、当社またはその他の著作権者等正当な権利者に帰属するものであり、お客様はこれらの権利を侵害する行為を行わないものとします。
2 本条の規定に違反して権利者あるいは第三者との間で問題が生じた場合、当社の責めに帰すべき事由によるときを除き、お客様は自己の責任と費用においてその問題を解決するとともに、当社に何の迷惑または損害を与えないものとします。
第8条 IDおよびパスワードの管理
1 お客様は、自己の責任において、お客様自身で設定した本サービスのIDおよびパスワードを管理し、第三者に譲渡または貸与してはなりません。
2 当社は、お客様のIDおよびパスワードの組み合わせが正当なものである場合、当該お客様のIDによる利用がお客様自身によるものであるとみなします。
3 当社は、当社の責めに帰すべき事由によるときを除き、お客様によるIDおよびパスワードの不適切な管理、使用上の過誤、第三者による使用等に起因する損害について一切の責任を負わないものとします。
4 お客様は、IDおよびパスワードが第三者によって不正に使用されていることが判明した場合には、直ちに当社に連絡するものとします。
5 お客様は、本サービス利用の際に行うクレジットカード番号の送信行為等に伴う漏洩等の危険性を認識し、自己の責任の下にこれを行うものとします。
第9条 個人情報の取り扱い
当社は、お客様から提供された個人情報をプライバシーポリシーに基づき適切に取り扱います。
第10条 商品の購入
1 お客様は、本サービスを利用して当社の商品を購入することができます。
2 お客様が、商品の購入を希望する場合は、当社が指定する方法に従って商品の購入を申し込むものとします。
3 当社がお客様に対して、前項の申し込みを承諾する旨の通知をお客様宛に発信した時点でお客様と当社との間に当該商品に関する売買契約が成立するものとします。
4 商品の所有権は、その商品のお客様への引き渡し時点をもって、当社からお客様に移転するものとします。
第11条 支払方法
お客様は、商品購入にあたり、当社が指定する支払方法を選択し、支払いを行うものとします。
第12条 商品の交換·返品および商品代金の返金
お客様は、商品の交換·返品および商品代金の返金については、当社の交換·返品ポリシーに従うものとします。
第13条 商品の配送
当社は、当社の配送ポリシーに従い、商品の配送を行うものとします。
第14条 契約の解除その他必要な措置
1 以下で定める各号にあたる事由が生じた場合には、当社は売買契約を解除することができるものとします。
(1)お客様が本規約に違反した場合
(2)お客様指定のクレジットカード会社からカード与信不履行の旨の連絡があった場合
(3)お客様の支払い能力が危うくなったと認めうる事情が判明した場合
(4)商品が品切れとなり、容易にお届けできない場合
(5)配送先不明・長期不在でお届けできない場合
(6)コンビニ受取りまたは店舗受取りが指定され、一定期間商品が受取られない場合
(7)未成年者が法定代理人の承認を得ずに購入していた場合
(8)その他、当社とお客様の信頼関係が損なわれた場合
2 当社は、お客様、当社または第三者のセキュリティを確保する必要が生じた場合、本サービスへの遮断、本サービスの全部もしくは一部の提供の停止もしくは中止、IDおよびパスワードの登録、会員登録の抹消、またはその他の適切な措置をとることができるものとします。
第15条 情報の管理
1 当社は、お客様が発信したコメントその他の情報について、以下で定める各号に該当する場合には、当社の判断によって、お客様に断りなくこれを削除することができるものとします。
(1)当該情報が当社もしくは第三者の著作権その他の権利を明らかに侵害し、または当社もしくは第三者の名誉もしくは信用を毀損していると認められる場合
(2)当該情報が第三者の著作権その他の権利を侵害し、または第三者の名誉もしくは信用を毀損しているとの警告を当社が当該第三者から受け取った場合
(3)法令に違反している場合
(4)法令上の根拠に基づき官公庁その他の公的機関から削除するよう命令を受けた場合
(5)その他本サービスの運営にとって不適切と認められる場合
2 当社は、お客様が前項各号に該当する場合、何らの通知なく、お客様が本サービスの全部またはその一部にアクセスすることを拒否することができるものとします。
第16条 本サービスの停止
当社は、本サービスの稼動状態を良好に保つために、以下で定める各号に該当する場合には、お客様に事前に通知を行うことなく本サービスの全部あるいは一部の提供を停止することができるものとします。
(1)システムの定期保守および緊急保守のために必要な場合
(2)火災、停電、第三者による妨害行為等によりシステムの運用が困難になった場合
(3)その他、やむを得ずシステムの停止が必要と当社が判断した場合
第17条 保証の否認および免責事項
1 本サービスは、提供時点での内容に基づき提供され、当社はその正確性や安全性を何ら保証するものではありません。
2 当社は、お客様に対して通知義務を負う場合は、お客様があらかじめ登録しているメールアドレスへ通知をすることにより、また、商品のお届けについては、商品購入の際、お客様が指示した送付先に商品を配送することにより、その義務を果たしたものとします。
3 当社は、法律上の請求原因如何を問わず、当社に故意又は重大な過失がある場合を除き、お客様に生じた損害、損失、不利益等について責任を負わないものとします。
4 お客様が、本サービスをご利用することで、第三者に対して損害等を与えた場合には、当社に故意又は重大な過失がある場合を除き、当該お客様は自己の責任と費用において解決し、当社には一切迷惑をかけないものとします。
5 当社は、お客様のパスワードの変更等を行う場合、当社指定の方法で本人確認を行うこととし、当該方法に過誤がない限りにおいて免責されるものとします。
6 お客様が本サービスを利用するのに必要なコンピュータ機器および通信機器等の設置に関する費用、本サービスを利用するために要した電話料金、LAN等の利用料および申請料金等は、お客様が負担するものとします。
第18条 反社会的勢力の排除
1 お客様は、当社に対し、以下で定める各号の事項を確約します。
(1)自らが、暴力団、暴力団関係企業、総会屋もしくはこれらに準ずる者または構成員(以下「反社会的勢力」といいます。)でないこと。
(2)反社会的勢力に自己の名義を利用させ、または反社会的勢力の利益に供するために本サービスを利用するものでないこと。
(3)自らまたは第三者を利用して、当社に対して脅迫的な言動または暴力を用いる行為や偽計または威力を用いて当社の業務を妨害しまたは信用を毀損する行為を行わないこと。
2 当社は、お客様が前項に違反した場合、当該お客様に何らかの通知または催告なく、会員登録抹消または契約の解除その他本規約に定める措置を講じることができるものとします。
3 前項の措置により発生した一切の損害について、当社は損害賠償、補償その他の責任を負いません。また、お客様は、第1項に違反したことにより当社に生じた損害等を賠償するものとします。
第19条 本規約および個別規定の変更
1 当社は、当社が必要と認めた場合に、本規約および個別規定を変更できるものとします。
2 お客様が、本規約または個別規定の変更後に本サービスを利用した場合、お客様は変更後の規約および個別規定に同意したものとみなします。
第20条 準拠法および裁判管轄
本規約、個別規定および本サービスに適用される準拠法は、日本法とします。また、本サービスの利用に関して生じる紛争(裁判所の調停手続きを含みます。)については、東京地方裁判所を第一審の専属管轄裁判所とします。

Terms of Service
STJ Creations Co., Ltd. (hereinafter referred to as the “Company”) establishes the following Terms of Service (hereinafter referred to as the “Terms”) governing the browsing of its online shop “sentoujours.” (hereinafter referred to as the “Site”), product purchases, membership registration, and related services provided on the Site (collectively, the “Service”).
Article 1 – Scope of Application
1. These Terms apply to all relationships concerning use of the Service between users of the Site (hereinafter referred to as “Customers”) and the Company.
2. In addition to these Terms, the Company may establish various rules and other provisions concerning the Service (hereinafter referred to as “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.
3. If these Terms conflict with the Individual Provisions described in the preceding paragraph, the Individual Provisions shall prevail.
Article 2 – Use of the Service
1. Customers shall use the Site only after agreeing to all provisions of these Terms and the Individual Provisions and shall comply with them.
2. If a Customer is a minor, the Customer shall use the Service only after obtaining the consent of a legal representative.
Article 3 – Membership Registration
1. Customers shall apply for membership registration when using the Service.
2. After agreeing to these Terms and the Individual Provisions, the Customer shall register the required information in accordance with the method prescribed by the Company. Registration is completed when the Company approves the application.
3. The Company may refuse to approve an application if any of the following applies. The Company will not disclose the reason for refusal:
(1) The application contains false information.
(2) The applicant has previously violated these Terms or the Individual Provisions.
(3) The Company otherwise determines that approval of the registration is inappropriate.
Article 4 – Suspension of Service and Cancellation of Membership
The Company may suspend provision of the Service or cancel a Customer’s membership without prior notice if any of the following applies:
(1) It is discovered that the Customer’s membership was previously canceled due to a violation of these Terms or other rules.
(2) The Customer delays payment or otherwise defaults on an obligation relating to the Service.
(3) The Customer engages in conduct prohibited under Article 6.
(4) A minor registers for membership or uses the Service without the consent of a legal representative.
(5) The Customer falls within the definition of antisocial forces set forth in Article 18.
(6) The Customer otherwise violates these Terms or the Individual Provisions.
Article 5 – Withdrawal from Membership
1. A Customer wishing to withdraw shall submit a withdrawal request in accordance with the method designated by the Company.
2. After completing the withdrawal procedure, the Customer will no longer be able to use the Service.
3. Even after withdrawal, the Company may retain the Customer’s information for a certain period in accordance with applicable laws and regulations.
Article 6 – Prohibited Conduct
Customers must not engage in any of the following acts:
(1) Providing false information when applying for membership registration.
(2) Interfering with operation of the Service or otherwise engaging in conduct that may disrupt the Service.
(3) Using a credit card fraudulently in connection with the Service.
(4) Improperly using an email address or password, including impersonating another Customer.
(5) Causing inconvenience, disadvantage, or damage to another Customer, a third party, or the Company, or engaging in conduct that may do so.
(6) Engaging in conduct contrary to public order and morals, violating laws or regulations, or engaging in conduct that may do so.
(7) Infringing the intellectual property rights of the Company or another legitimate rights holder, including copyrights.
(8) Damaging or interfering with the Company’s servers or network functions, or otherwise obstructing operation of the Service or use of the Service by other Customers.
(9) Any other conduct the Company deems inappropriate.
Article 7 – Copyright
1. Copyrights, trademarks, and all other intellectual property rights in wording, images, designs, and other materials used in the Service belong to the Company or other legitimate rights holders. Customers must not infringe these rights.
2. If a dispute arises with a rights holder or third party due to a violation of this Article, the Customer shall resolve the matter at the Customer’s own responsibility and expense, except where the cause is attributable to the Company, and shall not cause inconvenience or damage to the Company.
Article 8 – Management of IDs and Passwords
1. Customers are responsible for managing the IDs and passwords they set for the Service and may not transfer or lend them to any third party.
2. If the combination of a Customer’s ID and password is valid, the Company will regard use under that ID as use by the Customer.
3. Except where attributable to the Company, the Company assumes no responsibility for damage arising from improper management of an ID or password, errors in use, use by a third party, or similar circumstances.
4. If a Customer discovers that the Customer’s ID or password is being used improperly by a third party, the Customer shall immediately notify the Company.
5. Customers acknowledge the risk of leakage and other risks associated with transmitting credit-card numbers and similar information when using the Service and do so at their own responsibility.
Article 9 – Handling of Personal Information
The Company will appropriately handle personal information provided by Customers in accordance with the Privacy Policy.
Article 10 – Purchase of Products
1. Customers may purchase the Company’s products through the Service.
2. A Customer wishing to purchase a product shall apply for the purchase in accordance with the method designated by the Company.
3. A sales contract for the relevant product is formed when the Company sends the Customer notice that it accepts the application described in the preceding paragraph.
4. Ownership of the product transfers from the Company to the Customer when the product is delivered to the Customer.
Article 11 – Payment Methods
When purchasing a product, the Customer shall select and use a payment method designated by the Company.
Article 12 – Exchanges, Returns, and Refunds
Customers shall follow the Company’s Exchange and Return Policy regarding exchanges, returns, and refunds of product purchase prices.
Article 13 – Product Delivery
The Company will deliver products in accordance with the Company’s Shipping Policy.
Article 14 – Cancellation of Contract and Other Necessary Measures
1. The Company may cancel a sales contract if any of the following circumstances arises:
(1) The Customer violates these Terms.
(2) The credit-card company designated by the Customer notifies the Company that credit authorization has failed.
(3) Circumstances are discovered that reasonably indicate the Customer’s ability to pay has become doubtful.
(4) The product is out of stock and cannot readily be delivered.
(5) Delivery cannot be completed because the delivery address is unknown or due to an extended absence.
(6) Convenience-store pickup or store pickup is selected and the product is not collected within the prescribed period.
(7) A minor made the purchase without the approval of a legal representative.
(8) The relationship of trust between the Company and the Customer is otherwise impaired.
2. If necessary to ensure the security of the Customer, the Company, or a third party, the Company may block access to the Service, suspend or discontinue all or part of the Service, cancel an ID/password registration or membership registration, or take other appropriate measures.
Article 15 – Management of Information
1. The Company may delete comments or other information posted by a Customer without prior notice if the Company determines that any of the following applies:
(1) The information clearly infringes the copyright or other rights of the Company or a third party, or is deemed to damage the reputation or credibility of the Company or a third party.
(2) The Company receives a warning from a third party that the information infringes that third party’s copyright or other rights, or damages that third party’s reputation or credibility.
(3) The information violates laws or regulations.
(4) A government agency or other public authority orders deletion based on legal grounds.
(5) The Company otherwise determines that the information is inappropriate for operation of the Service.
2. If a Customer falls under any item of the preceding paragraph, the Company may deny the Customer access to all or part of the Service without notice.
Article 16 – Suspension of the Service
To maintain the Service in good operating condition, the Company may suspend all or part of the Service without prior notice in any of the following cases:
(1) When necessary for scheduled or emergency system maintenance.
(2) When system operation becomes difficult due to fire, power failure, interference by a third party, or similar circumstances.
(3) When the Company otherwise determines that suspension of the system is unavoidable.
Article 17 – Disclaimer of Warranties and Limitation of Liability
1. The Service is provided based on its content as of the time of provision, and the Company makes no warranty as to its accuracy or safety.
2. Where the Company has an obligation to provide notice to a Customer, that obligation is fulfilled by sending notice to the email address registered in advance by the Customer. With respect to delivery of products, the obligation is fulfilled by delivering the product to the shipping address designated by the Customer at the time of purchase.
3. Regardless of the legal basis of a claim, the Company shall not be liable for damage, loss, disadvantage, or other harm incurred by a Customer unless the Company acted intentionally or with gross negligence.
4. If a Customer causes damage or other harm to a third party through use of the Service, the Customer shall resolve the matter at the Customer’s own responsibility and expense unless the Company acted intentionally or with gross negligence, and shall not cause any inconvenience to the Company.
5. When changing a Customer’s password or taking similar action, the Company will verify the Customer’s identity using the method designated by the Company and shall not be liable provided there is no error in that method.
6. Customers shall bear the cost of installing computer and communications equipment necessary to use the Service, as well as telephone charges, LAN usage fees, application fees, and other expenses required to use the Service.
Article 18 – Exclusion of Antisocial Forces
1. Customers represent and warrant to the Company that:
(1) They are not an organized crime group, a company affiliated with an organized crime group, a corporate racketeer, a person equivalent thereto, or a member thereof (collectively, “Antisocial Forces”).
(2) They will not allow Antisocial Forces to use their name or use the Service for the benefit of Antisocial Forces.
(3) They will not, personally or through a third party, make threats or use violence against the Company, or use fraudulent means or force to obstruct the Company’s business or damage its credibility.
2. If a Customer violates the preceding paragraph, the Company may cancel the Customer’s membership, terminate the contract, or take any other measures prescribed in these Terms without notice or demand.
3. The Company shall not be liable for any damage arising from measures taken under the preceding paragraph. The Customer shall compensate the Company for damage incurred as a result of the Customer’s violation of Paragraph 1.
Article 19 – Amendments to These Terms and Individual Provisions
1. The Company may amend these Terms and the Individual Provisions when it deems necessary.
2. If a Customer uses the Service after these Terms or the Individual Provisions have been amended, the Customer will be deemed to have agreed to the amended Terms and Individual Provisions.
Article 20 – Governing Law and Jurisdiction
These Terms, the Individual Provisions, and the Service are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over disputes arising in connection with use of the Service, including court mediation proceedings.
